1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the "How To Read Minds and Influence People" application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Enigma Of The Mind ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Continued use of the App following any changes constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically.

2. ELIGIBILITY & LICENSE GRANT

2.1 Who Can Use This App?

The App is designed for professional and amateur magicians, mentalists, and performance artists ("Users"). By using the App, you confirm that:

  • You are 18 years of age or older

  • You have a genuine interest in magic, mentalism, or performance arts

  • You understand and respect the traditions and ethics of the magic community

  • You will use the App responsibly and legally

2.2 Limited License

Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial entertainment, educational, or performance purposes. This license allows you to:

  • Download and install the App on your personal device(s)

  • Use the App to perform magic/mentalism effects in live audiences

  • Access all features and content included in the App

This license is personal to you and does not grant you ownership of the App or any intellectual property contained within it.

3. INTELLECTUAL PROPERTY & PROTECTION OF SECRETS

3.1 Proprietary Content

The App contains proprietary methods, techniques, and intellectual property owned exclusively by Enigma Of The Mind. All content, including but not limited to:

  • The underlying methodology and technique

  • Software code and algorithms

  • User interface design

  • Graphics, text, and documentation

  • Audio, video, and instructional materials

...are protected by copyright and other intellectual property laws.

3.2 Respect for Magic Traditions

As a user of this App, you agree to respect the traditional ethics and code of the magic community:

  • You will not reveal, explain, or expose the secret method or technique to non-magicians

  • You will not describe how the App works to anyone who has not purchased it

  • You will not distribute, share, or sell the App or its contents to others

  • You will not attempt to reverse-engineer, decompile, or discover the underlying mechanism

  • You will not create or distribute tutorials explaining the App's secrets

Violation of these principles undermines the entire art form and may result in immediate termination of your license and legal action.

4. RESTRICTIONS ON USE

4.1 Performance Use Restrictions

You are granted permission to use the App in live, in-person performances to paying audiences. However:

  • Television, Film, and Professional Broadcasting: You may NOT use the App in any television production, film, movie, professional broadcast, or similar visual media without prior written consent from Enigma Of The Mind

  • Internet & Digital Recording: You may NOT record the App or your performance using the App for upload to YouTube, TikTok, Instagram, Facebook, streaming platforms, or any other internet-based platform without prior written consent from Enigma Of The Mind

  • Social Media: You may NOT post videos or recordings showing the App in action on any social media platform

  • Conferences & Events: Use at magic conventions, seminars, or promotional events is permitted only for live performance; recording is prohibited

4.2 Prohibited Uses

You agree that you will NOT:

  • Use the App for fraudulent, deceptive, or illegal purposes

  • Use the App to scam, deceive, or manipulate people for financial or personal gain

  • Use the App in any context where the audience believes they are experiencing genuine mind-reading rather than entertainment/magic

  • Sell, rent, lease, transfer, assign, or sublicense the App to anyone else

  • Remove, alter, or obscure any copyright notices, licenses, or proprietary markings

  • Use the App in violation of any applicable law or regulation

  • Attempt to gain unauthorized access to the App's systems or infrastructure

  • Use the App in any way that could harm, disrupt, or interfere with our services

4.3 Commercial Use

Personal, paid performances (performing for an audience that pays admission) are permitted under this license. However:

  • You may NOT license the App to others for performance

  • You may NOT offer workshops or training using this App without explicit written permission

  • You may NOT incorporate this App into a commercially-sold product or service without permission

5. ACCEPTABLE USE POLICY

5.1 Responsible Use

As a licensed user, you agree to:

  • Use the App only for entertainment and performance purposes

  • Perform the effect with integrity and respect for your audience

  • Comply with all applicable laws and regulations in your jurisdiction

  • Immediately cease use if requested by Enigma Of The Mind

  • Report any unauthorized use, piracy, or violations you become aware of

5.2 Consequences of Misuse

If we discover that you have violated these Terms, we reserve the right to:

  • Immediately terminate your license without refund

  • Disable your access to the App

  • Report illegal activity to appropriate authorities

  • Pursue civil or criminal legal action

  • Require you to pay damages and legal fees

6. PAYMENT, ACCOUNTS & REFUNDS

6.1 Purchase & License Activation

  • The App is sold as a one-time purchase that grants a permanent license (subject to these Terms)

  • Upon purchase, you receive a personal account with a unique login

  • Your account is non-transferable and personal to you only

  • You are responsible for keeping your account credentials confidential

6.2 Refund Policy

  • The App is non-refundable once purchased. This policy exists because:

    • Once downloaded and accessed, the proprietary secrets and techniques contained within the App are exposed to you

    • Refunding the purchase after access would allow people to learn the secret method without paying

    • This would violate intellectual property protection and undermine the magic community's code of secrecy

6.3 Account Termination

We may terminate your account and license if:

  • You violate any provision of these Terms

  • You use the App illegally or unethically

  • You expose or reveal the secrets or techniques of the App

  • You attempt to circumvent access controls or technical protections

  • You engage in any form of fraud or misrepresentation

Termination is immediate and final.

7. WARRANTY DISCLAIMER & LIMITATION OF LIABILITY

7.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OF IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose

  • Warranties that the App will be uninterrupted, error-free, or secure

  • Warranties that the App will perform as expected in all performance contexts

We do not warrant that the App will:

  • Work flawlessly in every situation or environment

  • Produce consistent results in all performance contexts

  • Be compatible with all devices or software versions

7.2 Performance Disclaimer

The App is designed to create the illusion of mind-reading for entertainment purposes. We do not warrant that:

  • Every audience member will be convinced or entertained

  • The effect will work equally well in all performance contexts

  • Your specific performance style or technique will yield guaranteed results

Success depends on your skill as a performer.

7.3 Limitation of Liability

To the maximum extent permitted by law, Enigma Of The Mind shall not be liable for:

  • Any direct, indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Damages arising from your use or inability to use the App

  • Damages resulting from performance failures, audience dissatisfaction, or reputational harm

  • Any claims arising from misuse or violation of these Terms

This limitation applies even if we have been advised of the possibility of such damages.

7.4 Your Sole Remedy

Your sole and exclusive remedy for any dispute is a refund of the App purchase price (if eligible under Section 6.2).

8. TECHNICAL SUPPORT & UPDATES

8.1 Support

We provide email-based technical support at support@enigmaofthemind.com. We will:

  • Respond to support inquiries within 5 business days

  • Assist with technical issues, bugs, or crashes

  • Provide guidance on using the App

We do not provide:

  • Coaching or performance advice

  • Refunds for personal performance failures

  • Customization or modifications

8.2 Updates & Changes

We may update the App periodically to:

  • Fix bugs and security vulnerabilities

  • Improve functionality

  • Maintain compatibility with new devices/OS versions

Updates may be required to continue using the App. Failure to update may result in loss of access.

9. PRIVACY & DATA

By using the App, you agree to our Privacy Policy (available at www.enigmaofthemind.com/privacy-policy). The Privacy Policy explains what data we collect and how we protect it.

10. THIRD-PARTY SERVICES & LINKS

The App may contain links to third-party websites or services. We are not responsible for:

  • The content, accuracy, or practices of third-party sites

  • Any damages or losses arising from your use of third-party services

  • The privacy practices of third-party providers

Use third-party services at your own risk and review their terms and privacy policies before use.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Enigma Of The Mind, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App

  • Your violation of these Terms

  • Your performance of the effect (including audience reactions or dissatisfaction)

  • Your infringement of any third-party rights

  • Any illegal or unethical use of the App

12. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of England and Wales, and you irrevocably consent to the jurisdiction of these courts.

13. DISPUTE RESOLUTION

13.1 Informal Resolution

Before pursuing legal action, you agree to attempt to resolve any dispute informally by contacting us at support@enigmaofthemind.com with a detailed description of the issue. We will work in good faith to resolve the matter within 30 days.

13.2 Legal Action

If informal resolution is unsuccessful, you may pursue legal action under the laws governing these Terms (Section 12).

14. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, will be severed. All other provisions remain in full force and effect.

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Enigma Of The Mind regarding your use of the App and supersede all prior negotiations, representations, and agreements, whether written or oral.
